@cf Prefer not to say. But with my start date had limited time to take it off. So I was like yeah it’s the law here, they will pay it. Nope did not.

@bt only the amount you are vested in + any of your own money you contributed. There is a vesting schedule on the benefits website. You are always 100% vested in your personal contributions, but vesting in company match varies by years of service. You need 5 years for 100% vesting. I have 2 years so I am only 30% vested.
@bw That’s awful! I guess maybe just take my PTO when I can cause that’s horrible if they don’t pay it out. I have Aug 2027 date so I guess I have time
@a1 They did not pay out mine and is mandated in my state.

I wasn't eligible for the VSP but was curious about 401k's. If you're not fully vested, did the VSP address this? Did they let you keep all of your 401k money that the company put in or are they taking it back? I'm concerned about this in case I'm RIF'd. I assume if that happens they'll keep their share.
Some states do in fact pay out PTO. I am in California and it’s paid out!

~~~part 7 (page 9) on mine states this. Keep in mind that I'm in MO and other states may/may not be the same. btw, I declined the VSP.
"Vacation and Sick Time – Accrued and unused Vacation/PTO time is not paid out at the time of your
Separation Date, except where required by law. Unused sick time is not paid out at the time of your
Separation Date, unless required by law."
@OP Obviously you did not apply for VSP because if you had you would already know the answer to your question.

no, only if mandated by your state law will it be paid out.
