Garden Leave or Immediate Termination?

Does anyone know whether, when someone is laid off, they receive a few months of garden leave, or are terminated immediately with a few month severance package instead?

Also, if anyone has gone through this, were you given a choice between garden leave and immediate termination with severance, or was it entirely decided by the company?

@b2 My understanding is that you continue to be paid and have benefits during the 60 day period, and then they may give you an additional lump sum at the end as severance.

@ay
Yes, I’m in the US.
You might not know, but do you think there would be a room for negotiation to request garden leave instead of being paid 60 days in lieu of notice?

It really depends on the laws of the country in which you are working. My understanding in the United States is that you may be paid 60 days in lieu of notice and whatever lump sum payment they offer you at the end. If you are over the age of 40 (in the US) they must give you extra time to agree to the severance you are offered.
