Would that work to not comply with new RTO and drag it out as long as possible till they terminate me or lay me off. Would this set me up for a possible layoff package and I could get unemployment benefits?

Non Compliance (which we all have to "Attest" to every year) provides Cause for Termination.
I will watch next Earnings package to see if any funds have ben set aside for severance packages, but having worked here 35 years and knowing these B0s-B2s pretty darn well, well... .just color me Skeptical.
I think they hope to reach their Attrition goal "organically". (meaning we quit)
So there will be no need to pay out any severance packages across the board.
THAT is the BofA way.
That said, I look forward to being proven wrong and hope one of you gets the 35-year severance package I walked away from this year.

I am NOT working a 10 hour day starting at 3:30am on the West Coast, to then have to haul my a^^ into some office for another 8 hours where I don't even know anyone (I'm sure they are nice people, but sorry, they are just a waste of my limited time)
Makes no sense. they lost a very productive worker and apparently split my former duties across 4 people (!). wtf.
@r3 thanks for the intel. I posted as mh below. This is good to know and I will push HR/accommodation team on this again. Maybe my doctor needed to write one year vs TBD once my condition resolves. It is such a shame that all of this is still so rigorous even for those of us actually on FMLA leave/with serious health conditions.
@OP So ironic how they scream about how inclusive they are but do everything they can to disallow people with any sort of medical issue, the ability to WFH. Also, if they really wanted to be more inclusive they would embrace WFH so that people living in "disadvantaged" areas well away from the campus settings, could work for the bank without undue hardship.
If you get terminated i.e. fired for non-compliance, don't expect a severance package
@j3 In some circumstances it can still go a year. I just went through all of this and I got mine approved until I can qualify for fmla.
@ka ok, got it. I was just chiming in because I’m actually out on FMLA leave and on the paperwork for that my doctor wrote that I need to work from home as an accommodation after returning to work for an undetermined amount of time based on my condition, etc. and the bank still told me that the bank’s accommodation department is separate from FMLA so the 90 day form still rules the roost.
@j3 @j3 I promise you I know they changed it to a form that says three months however, I had my doctor write in two years with a specific enddate of January XX, 2028. If you have the form they wrote it under number two on the part of the Dr filling down and then said work from home five days a week and the same thing for the return of of January XX, 2028. It won’t let me paste things in this post so I took a copy of the wording, but they wrote it in for me under number two and number three and this was after advice from the advocate that works With The Bank because I’ve been working from home for medical reasons. That will not be chancing and they said just to put an in date further out. THE REMAINDER OF THIS FORM MUST BE COMPLETED BY THE TREATING HEALTH CARE PROVIDER OR OFFICE STAFF.
- Please advise why it is medically necessary for the employee to work from home for the next 90 days and how they are otherwise impacted when working in the office. If end date within the 90 days is uncertain or unspecified, recertification is required.
- Please describe any alternative in-office accommodations that would support the employee, in lieu of working from home (e.g., private office, wellness room, ergonomic equipment, lighting adjustment, etc.)?
- If there are no alternative accommodations that we can provide to allow the employee to work in office, please indicate how many days per week they need to work from home: (circle one) 1 2 3 4 5 my doctor wrote in under two and three please allow Jane doe from home until January XX 2028 and we did this form this January in the form has the three months written as you can see but I was told my doctor ignore that and put it further out in date so I wouldn’t have to continue to do it. And yes, I put a date not XX but I didn’t want it to have it my exact date just in case I know this stuff is anonymous but it makes me nervous. Multiple people on my team have also had a date that’s more than three months out. Your doctor can change provide a date further out than just a three months time period. I hope this helps a lot you because I can’t imagine being in the office anymore. I do miss seeing people, but now my team is all across the United States so I wouldn’t see any of them anyways.

I was just blown off by 3 members of the accommodations team just being passed along without talking to me. Only got 3 months. I just told one of the managers that I am fighting coming back due to a hostile work environment and don't care what happens anymore. Shorthanded with all this anxiety I really don't give a sh-t anymore. I got my evidence ready for when they confront me. To quote my recently departed mother 'you do what you gotta do'.
Expecting a package for provable non-compliance with work policies is certainly a strategy. If severance was the goal, they could just do that today without cause.
Their goal is to get us to quit. Moynihan does not want to spend any funding on layoffs.

@OP Bad move hombre. You could be terminated with cause (insubordination) and you won't even get unemployment.
There are rumors that those who don’t abide by the new WPE policy WILL be offered a severance package based on their years of service.
After the 6 month “monitoring” period, a final decision will be made on the amount of time that will be offered, per month/years of service.
Estimated natural attrition of under 1% and 3-4% through the WPE severance policy that will be rolling early Q2.

First off unemployment isn't much money - you probably would not even qualify since you would be fired for cause. Employer can mandate you come in 5 full days and failing to comply would be the fault of the employee.
Probably not since it could be seen as a termination with cause by not following a policy.
