Thread regarding Centene Corp. layoffs

Is accrued PTO paid out if they lay you off?

I can't find anything in the employee handbook about PTO payout rules...... which makes me think Centene's gonna let it defer to state payout rules. If they can weasel out of paying employees their dues they prob will.

I can only assume:

  • PTO won't be paid out
  • Sick won't be paid out
  • Personal vesting schedule at the time of one's termination holds true (I worked at a company 8 years ago that fully vested anyone they laid off.....man, those were the days!)

If I'm on the chopping block then I don't wanna leave anything on the table. So what do you think, do I feel a cold coming on? Did my in-laws surprise me and the wife with cruise tickets? lmao

@b3 THANK YOU! I swear our fellow employee's do not read or comprehend what their benefits even are. Its safe to say, for most, you get nothing AND there IS a mandatory you have to be on the clock working, the last two weeks to get paid. NOT burn up your vacation or sick time to the last day........There are really no state laws that say any company MUST give you any kind of severance package either. That is another educational rant.

I hope my PL gets canned. I believe she is committing payroll fraud, time off fraud. I do not think it is the first time. There is a group of managers within the department known as the Michigan Mafia. They are a close knit group of managers and coworkers who have been stealing time for about 3 years.

Just a friendly FYI — whether your accrued PTO gets paid out when you leave is completely dependent on your state. Centene’s Employee Handbook says PTO will not be paid out at termination unless your state legally requires it. So, it isn’t automatic; it’s based on your state’s laws.

Strict Mandate States:

  • California: Prohibits "use-it-or-lose-it" policies; all earned and unused PTO must be paid out on the final day.
  • Colorado: Treats accrued vacation as wages that must be fully paid upon separation.
  • Montana: Forbids forfeiting earned time off and mandates a payout at termination.
  • Nebraska: Requires all earned, unused vacation or PTO to be paid out upon separation.

Conditional or Policy-Dependent States:

  • New York & Ohio: Require payouts of accrued unused PTO unless a clear, written company policy explicitly states it will be forfeited.
  • Louisiana & Illinois: Mandate the payout of accrued, unused vacation time upon termination regardless of the reason for leaving.

If it’s not paid out sure use all you can! I have a 08/27 severance date and my state does pay out PTO guess I stack it until I am let go.

the policy is in Archer. it's not in the employee handbook.

that said, PTO and sick time is not paid out unless mandated by the state in which you reside.
