The problem with lawsuits is you have a burden of proof and EM has had lots of legal reviews of its "system" and its documentation. Plus it has statistics which prove no Systemic discrimination. So you and your lawyer have a big hurdle because you lack data and statistics which EM has maintained for decades. You need solid Proof and evidence. HR tests its ranking group groups to see if there is any age or race bias statistically and rankings are adjusted if there is statistically proven bias.

Rare for EM to lose a discrimination case. Most lawyers will not waste the time unless you have significant documentation/proof. Texas is an "At Will state, so your odds are significantly reduced, plus you had an obligation to report past discrimination, so any old claims that were not reported are discounted.
So like everything else Xom gambles if you will lawyer up or not. Also Xom they do lose with the right lawyer.

The Age Discrimination in Employment Act (ADEA) of 1967 is the primary U.S. federal law that protects older employees (and job applicants) from age-based discrimination.
Key points about the ADEA:
It protects people age 40 and older.
