The Allegations: Investigators found that WellCare inflated spending reports (just like Centene and the Pharmacy) to avoid returning unspent money required by Florida's behavioral health profit-capping laws.
Corporate Settlement: The company entered a Deferred Prosecution Agreement in 2009, paying $80 million in restitution and forfeitures, followed by a $137.5 million False Claims Act settlement in 2012.
Executive Convictions Todd S. Farha: The former CEO was convicted of health care fraud and sentenced to 36 months in prison.
Other Executives: Former CFO Paul Behrens, former VP William Kale, former VP Peter Clay, and former General Counsel Thaddeus Bereday were also convicted or pleaded guilty to criminal charges and false statements.
